Acceptance of Terms

By accessing or using SMTPPrime, you agree to be bound by these Terms & Conditions (the “Terms”). If you do not agree with these Terms, please do not use the service.

These Terms apply to the SMTPPrime website, applications, features, products, and related services we offer, where applicable (together, the “Service”). The Service is operated by Mondal Global Trading (“we”, “us”, or “our”).

If you use the Service on behalf of a business or other organization, you confirm that you have the authority to accept these Terms on its behalf.

Eligibility

SMTPPrime services are intended for individuals aged 18 or older.

By using the Service, you represent that you meet the applicable age requirement and that you have the legal capacity to enter into these Terms.

We do not claim that the Service is available in every country or region. Availability may vary based on applicable laws and service restrictions, and we may limit or restrict access where necessary.

Your Account

You may need to create an account to access certain features of the Service. You are responsible for:

• Providing accurate and complete information
• Keeping your account information up to date
• Protecting your login credentials
• Maintaining the confidentiality of access to your account
• Activities that occur through your account

If you suspect that your account has been accessed without authorization, please notify us promptly at info@smtpprime.com so that we can help look into the matter. We will take reasonable steps to assist, but we are not responsible for every account security incident, particularly where it results from circumstances outside our reasonable control or from a failure to safeguard your credentials.

Our Services

SMTPPrime provides email communication tools and related digital services, as described in your selected plan or order. Your plan determines the features, sending limits, usage allowances, and support available to you.

Email delivery depends on recipient servers, sender reputation, authentication, message content, and other factors outside our control. We do not guarantee inbox placement, open rates, or campaign results. You must follow your plan limits and must not bypass sending restrictions. Material changes to paid services will be communicated where required by your agreement or applicable law.

Plans, Pricing and Payments

Certain SMTPPrime features may require payment. Current pricing is displayed on the applicable pricing page. Please note that:

• Prices may vary by plan
• Billing frequency may be monthly or annual, depending on the plan you select
• Applicable taxes may apply in addition to the listed price
• You are responsible for providing accurate billing information
• Payments are processed through authorized payment providers

Payment transactions are processed by the payment provider shown at checkout. By selecting a paid plan, you authorize the applicable payment provider to process the charges associated with your selected plan. Payment providers operate under their own terms and privacy policies.

Before you purchase, review the total price, billing period, usage limits, renewal conditions, and any refund policy shown at checkout. A subscription renews automatically only where this is disclosed and you authorize recurring billing. You can request cancellation at info@smtpprime.com if account cancellation tools are unavailable. Cancellation stops future renewals; any remaining access and refund eligibility follow the terms disclosed at purchase and applicable law. Price changes apply to future billing periods with any notice required by law. Unused allowances do not roll over unless your plan expressly says otherwise. Free Trials and Promotions

This section explains how free trials and promotions work if and when they are made available. It does not mean that any particular trial or promotion is currently offered.

• Promotional pricing may be offered from time to time
• Trial periods may have eligibility requirements
• Promotional offers may be subject to separate terms
• We may modify or discontinue promotions where permitted by applicable law

Any specific trial length, eligibility criteria, or promotional conditions will be communicated at the time the offer is made.

Acceptable Use

You agree to use the Service lawfully and responsibly. You must not use SMTPPrime to:

• Break applicable laws or regulations
• Commit fraud
• Impersonate another person or organization
• Distribute malware or other harmful code
• Attempt unauthorized access to systems or accounts
• Interfere with or disrupt the Service
• Circumvent security measures
• Abuse system resources
• Send unlawful or harmful content
• Infringe intellectual-property rights
• Harass or threaten others
• Facilitate illegal activity

Email and communication use

You must have the necessary permissions or other lawful basis to contact recipients, identify the sender accurately, and avoid deceptive subject lines. Marketing messages must include a working unsubscribe method and sender contact details where required by law. Honor opt-out requests within applicable deadlines and do not send further marketing messages to recipients who have opted out.

If you use SMTPPrime for email or other communication purposes, you must also comply with all laws that apply to your messages. You must not use the Service for:

• Spam
• Unlawful bulk messaging
• Phishing
• Fraudulent communications
• Malicious campaigns
• Messages sent without appropriate authorization or legal basis

We may investigate suspected violations and take appropriate action, including removing content or suspending access, as described in Suspension and Termination.

Intellectual Property

The following may be owned by, or licensed to, Mondal Global Trading and are protected by applicable intellectual-property laws:

• SMTPPrime branding
• The website
• Software
• Designs
• Interfaces
• Logos
• Content
• Documentation

Subject to these Terms, you receive a limited, non-exclusive, non-transferable right to access and use the Service for its intended purposes. No ownership rights are transferred to you, and nothing in these Terms grants you the right to use our names, logos, or branding except as expressly permitted.

User Content

You may provide information or content while using the Service. You retain ownership of content that you own, subject to the rights necessary for SMTPPrime to provide, operate, and maintain the Service for you.

You represent that you have the appropriate rights and permissions to submit any content or information you provide to the Service.

Third-Party Services

SMTPPrime may use third-party providers for payments, hosting, security, analytics, or integrations. The providers used may change. Refer to our Privacy Policy for information about personal data processing.

Third-party services may have their own terms and privacy policies. When you interact with those services, you may be subject to the applicable terms of the third-party provider. We do not control third-party services and are not responsible for their content, policies, or practices.

Service Availability

We aim to provide a reliable Service, but we do not guarantee that it will be uninterrupted or error-free. The Service may be temporarily unavailable due to:

• Maintenance
• Updates
• Technical issues
• Security incidents
• Infrastructure failures
• Third-party service interruptions
• Events outside our reasonable control

Unless a specific service level has been expressly agreed in writing, we do not commit to any particular uptime level.

Privacy

Your use of SMTPPrime is also subject to our Privacy Policy, which explains how we collect, use, protect, and manage personal information.

Security

SMTPPrime uses reasonable technical and organizational safeguards intended to protect its services and information. However, no online service or method of transmission can be guaranteed to be free from risk, and we cannot promise that the Service will never be affected by a security incident.

You are also responsible for maintaining appropriate security for your own account, devices, and credentials, such as using strong passwords and keeping them confidential.

Suspension and Termination

We may suspend or terminate your access to the Service where reasonably necessary, including in situations involving:

• Violation of these Terms
• Illegal activity
• Fraud
• Abuse
• Security risks
• Non-payment
• Misuse of the Service

You may cancel your subscription through your account or by contacting info@smtpprime.com. Stopping use alone does not cancel authorized recurring payments. We may suspend access immediately for urgent security, abuse, or legal reasons; otherwise, where practical, we will provide notice and an opportunity to resolve the issue. Contact us if you believe a suspension was made in error.

Refunds are not automatic. Whether you are eligible for a refund depends on the applicable pricing and subscription terms and on any rights you may have under the laws that apply to you.

Disclaimers

Unless expressly stated otherwise, the Service is provided on an “as is” and “as available” basis, to the extent permitted by applicable law.

SMTPPrime does not guarantee that:

• The Service will always be uninterrupted
• The Service will always be error-free
• Every feature will remain available
• The Service will meet every individual business requirement

Nothing in these Terms excludes or limits any rights or warranties that cannot legally be excluded or limited under the laws that apply to you.

Limitation of Liability

To the maximum extent permitted by applicable law, SMTPPrime and Mondal Global Trading will not be liable for certain indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of, or inability to use, the Service.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

To the extent permitted by applicable law, you may be responsible for claims, losses, and reasonable costs arising from:

• Your misuse of the Service
• Your violation of these Terms
• Your violation of applicable laws
• Your infringement of third-party rights

This section applies only to the extent permitted by applicable law.

Changes to These Terms

We may update these Terms from time to time. When we make changes:

• The effective date will be updated
• We will provide notice of material changes through the Service or your account contact details where required by law

Changes apply from their stated effective date, subject to applicable notice requirements. If you do not accept a change, you may stop using the Service and cancel future renewals before it takes effect. Your continued use of the Service after updated Terms take effect means you accept them, to the extent permitted by applicable law.

Governing Law and Disputes

Depending on where you live, you may have rights under the laws applicable in your location. Nothing in these Terms limits any mandatory rights that apply to you.
